I think, that the MOH is played in both scenarios. You can probably try to disable MOH (sip-enable-moh) on SIP server and afterthat the call-legs will stay inactive. In any other cases, the MOH is played - i.e. MS is required.

The question is whether a two-step transfer can be performed without MS. That would be yes, if I don't have MS, as per the documentation (SIP Server deployment course, wiki etc), the 2-step transfer can be achieved without it, i.e. MS is not a mandatory requirement.
Clearly, it there's MS, sip-enable-moh is set to true etc, MS will be used and music played.
